The organisation of school enforcement

Although linked to the very beginnings of State intervention in school provision, school attendance enforcement had no national framework, and was organised at a local level. The education welfare service (EWS) is not a statutory function: there is no legal requirement for LEAs to have an EWS, although the LEA has to exercise its legal duties under section 437 of the Education Act 1996 through some form of service or agency. There has never been a national pay or professional structure, but in the early years a recognition of the parallels with social work lead to an alignment with social work training and qualifications, resulting in some LEAs employing educational social workers, or social workers in education.

Although the service itself is not a statutory one, each LEA has to devise strategies for discharging its duties and responsibilities for ensuring school attendance, for monitoring and regulating child employment, and these duties have traditionally been discharged by the EWS.
